San Jose Business Journal is reporting that Apple had requested for the criminal investigation of lost iPhone 4G prototype incident.

Police have apparently identified and interviewed the person who had found the next generation iPhone prototype that was left by an Apple engineer in a San Jose bar.

It is still not clear whether the person interviewed by the police is the same person who sold the lost iPhone to Gizmodo for $5000.

We had reported over the weekend that police was investigating the lost next generation iPhone prototype incident.

Gizmodo has just reported that California’s Rapid Enforcement Allied Computer Team entered their editor Jason Chen’s house on Friday night with a search warrant and has confiscated a total of 24 items, which includes computers and servers used by him.

Gizmodo has published details about the raid on its website.

“Last Friday night, California’s Rapid Enforcement Allied Computer Team entered editor Jason Chen’s home without him present, seizing four computers and two servers. They did so using a warrant by Judge of Superior Court of San Mateo.”

Ever since Gizmodo published pictures of the next generation iPhone, there have been a lot of questions raised over the prototype’s closeness to the final shipping product. Apple has traditionally developed several prototypes of its upcoming devices before a final decision on the design is taken.
This is one reason why the new iPhone prototype published by Gizmodo did not completely match with the pictures posted by a Chinese Twitter user earlier this year.

The tale of the lost prototype is now a late-night comedy joke — and not a very funny one

David Letterman, with great reluctance, used the story of Apple’s (AAPL) misplaced iPhone as fodder for his top 10 list Wednesday night.

“Frankly I’m a little sick — fed up — with the Apple people,” he begins. “Because, first of all, nobody’s got any money. And second of all, would we need it on a thing that makes our life easier?”

Letterman briefly summarizes the story, which dominated the tech press in the early part of the week (see here), and then offers the excuses.

I think we can definitively say that Gizmodo has put a massive crimp in Apple’s existing publicity plans for the next iPhone. When Apple announces the phone, the Reality Distortion Field may be a tad less potent than usual. But even if we assume for the sake of argument that the phone Apple releases will be identical to the one that Gizmodo bought from a barfly, there’s plenty that we may not know until Apple has its say–and , just as important, until reviews and consumers get their hands on real, fully-functioning units.

Such as:

1. How fast is it? Gizmodo didn’t have anything to say about the CPU inside the phone. Seems like there’s a pretty good chance it’s something at least vaguely akin to the Apple-designed A4 inside the iPad. Given how zippy the iPad is, that could be as big a deal as anything Giz was able to divine.
